Saying ‘not financial advice’ won’t keep you out of jail — Crypto lawyers
Crypto influencers may need to practice what they preach and “do their own research” when it comes to sharing their crypto tips. According to several digital asset lawyers, the popular disclaimer “This is not financial advice” may not actually protect them in the eyes of the law.
United States-based securities lawyer Matthew Nielsen from Bracewell LLP told Cointelegraph that while it’s “best practice” for influencers to disclose that “this is not financial advice,” simply saying the term will not protect them from the law, as “federal and state securities laws heavily regulate who can offer investment advice.”
Australian financial regulatory lawyer Liam Hennessy, a partner at Gadens, explained that “advice warnings” are “by and large pretty useless,” while Australian digital lawyer Michael Bacina of Piper Alderman added that they aren’t “magic words which when uttered will disclaim liability.”
Crypto influencers and celebrity ambassadors have been increasingly finding themselves under the scrutiny of regulations, particularly in the United States.
Nielsen cited the recent Kim Kardashian case as an example, where Kardashian was charged by the SEC for failing to disclose how much she received to promote EthereumMax (EMAX) to her followers. [Source: CoinTelegraph]
Crypto Exchange Kraken Launches 'Gasless' NFT Marketplace
Kraken has launched a beta version of Kraken NFT. The marketplace offers gasless transactions and an intuitive design. It is currently only open to some customers on the waitlist. Kraken NFT features an NFT aggregator that allows users to view and purchase NFTs listed on other marketplaces. Users can use over 200 cryptocurrencies and eight fiat currencies to buy NFTs. The marketplace will collect royalties on the creators' behalf and distribute them once a collection's creator has been verified. [Source: CoinDesk]
Is Twitter’s Future Under Elon Musk Filled With NFTs? Its Latest Feature Allows Users to Buy and Sell Crypto Art Via Tweet
The platform's new integration may point to where the social media company is headed. In an integration Twitter has called NFT Tweet Tiles, users will be allowed to buy, sell, and showcase NFTs through tweets. The feature, which is still being tested, has an enlarged panel for displaying an NFT artwork and offers a click-through button to marketplace listings.[Source: ArtNet]
Coinbase is Giving Away ENS Usernames to Make Crypto Wallet Transfer Easier
Major crypto exchange Coinbase has announced that it’s been working with decentralized identity infrastructure provider Ethereum Name Service (ENS) to offer Coinbase-managed web3 usernames free to users – enabling them to use that username instead of a traditional address to send and receive crypto.
