John: We are indeed working on it. Future updates will come from official channels.

John: I don't comment on the lending markets. However, through the utilization of blockchain and web/// tech, it does eliminate a lot of friction points (points where efficiency can be improved) in many different sectors of technology

Wenhoverboard: Yep. A lot has changed since then though.

John: Not wishful thinking. I get my timelines from our Director of PMO and our Director of Products, as well as updates regarding product progress. If things change, we will let folks know through official channels.

John: Things change. And SafeMoon is not the only company subject to delays and changes. I am sorely disappointed that the cybertruck is delayed. However, i know when Tesla releases the final product, it will be worth the wait.


POA Model

Mrblacks37: I get that but i just think the quiet and ambiguity is what's causing the angst in the community. If there was communication that was out that kind of laid out what a roadmap is and what is expecting to be accomplished, I think that would calm a lot of people

John: We are looking at a POA model, but not in the traditional sense. We are also exploring an evolution to Gas fees (this is subject to change as we build, break, fix and iterate what we are building in the non-public domain) Again, any official news will come from official channels. But we are indeed actively working on it, as well as other products and features.

Wenhoverboard: John mentioned Proof Of Authority (atleast that’s what I thought he was insinuating) but, he also said not in the traditional sense. Could you explain what you mean by that?

John: Not at this time.


SafeMoon Exchange

ChampOfSun 🌞 (aka Janky 🥞s) : People still bring up the charity India covid donation and where did that go, that would be nice to have settled once and for all.

HughscL 💳: Simple: there was never money collected for that. The money collected was for the development of the exchange. That was just an idea that didnt come to be done. Thats why they are also careful with what they share today. If something they share changes, or is not done, people will be upset.

John: Exchange is very much under development, VERY much so.


Wenhoverboard: Any transparency or like a quick 2 minute video on what you guys are waiting on with relation to the exchange release would be greatly appreciated. The more transparent the team is the more the trust is restored for me personally. Delays happen and if they happen you won’t hear me complain if we know why something was delayed. That’s my personal take on the product releases.

John: No 2 minute video needed. Compliance is the main hold-up, and I will not rush that. In house legal is handling that.

Wenhoverboard: So, with all due respect compliance is a general term. What specifically with relation to compliance is causing the delays? The specifics matter to me as a holder on these types of things.

John: I am not educated enough to give the best response, as our actual head of compliance and our legal team handles that. Believe it or not, its a team effort, and everyone has knowledge gaps. That is why you build a strong team, create a strong phalanx and strong unit cohesion to complete the mission.

And yes, we do have internal legal team, as well as outside counsel, which is pretty standard for companies.

Wenhoverboard: I can appreciate that but, legal must be telling you what is delaying the release right? I’m not asking you to give us a date. I’m just asking if legal can let the community know what compliance hurdles are left to be completed.

John: Not sure i can comment on that. But Ill see what i can and cannot say 🙂

Mrblacks37: If it has something to do with legal things, shouldn't it be able to be disclosed? Like a legal article number that is being complied to, etc?

John: That portion is not in my day-to-day right now. I delegated it to legal. So again, won't be commenting on it during this Serious Chat session


Regulatory Education

goateau: John if you still here, have you enjoyed the regulatory process from an academic standpoint or not rly? Just curious because I somewhat liked seeing the sausage being made, but it was frustrating as well

John: I always love the opportunity to gain more knowledge. I have an ethos of “I will never know it all” as there is always more to learn. So I have enjoyed gaining more knowledge during this journey. Be a sponge, and never stop soaking up knowledge.


SafeMoon Security

HughscL 💳: Hacks and exploits are happening in other projects, and here they are focusing on the security aspect. Let them work. If they release anything, and a hack or exploit happens, even if things are insured, the first people wanting to burn us all, will be those that demanded things to be released today and right now.

John: Security is a big priority of mine. If there is a security concern, that's usually a reason why I won't or will delay a project. Or if the feature is too difficult to use, I will delay it. We focus on user experience first, then we build backward from there. Humans have to use these products, so we have to everyone proof (as best we can) each feature set, and product.


Feedback/FUD

HughscL 💳: I always will deliver concerns if they are presented in a respectful way. Always. There was a hint in one of the tweets from SafeMoon regarding this, that also confirms that is not ECB.

John: Hugh indeed does deliver concerns and feedback. All the moderators do. And I appreciate it. FUD plays an important part in the innovation and evolution process. Not all feedback is FUD, but all FUD is indeed feedback aka Data to make decisions.

longingforwinter: I still hope SFM brand cereal is on the table for 2023

John: I have asked one of my folks in charge of merchandise to look into creating FUD flakes in a limited capacity.

John: Indeed. Encryption integration with a wallet is just a beginning. There are many different avenues to apply encryption tech to like chat, file storage etc.

Regulation in Crypto

You need to understand that too much regulation hinders innovation. But uncertain regulation is equally as bad. Businesses won't dedicate time, effort and capital into crypto - only for their actions to be declared illegal.


The Problem

The U.S. financial markets are regulated by independent agencies whose jurisdiction overlaps. This creates confusion and chaos. Imagine how difficult it must be to enforce laws. The SEC and the CFTC are the two important ones mentioned in the bill.


Here's why:

The SEC

They benchmark protocols with "The Howey Test". The Howey Test determines what qualifies as an "investment contract" and would therefore be subject to U.S. securities laws.

A security being loosely defined as a tradable financial asset. Examples are stocks and bonds. Responsible Financial Innovation Act


The Lummis-Gillibrand bill effectively divides the digital asset world into three:

- Commodities

- Securities

- Ancillary assets (crypto tokens with no revenue)


So is the bill actually good for crypto?

Yes, here's why:


The CFTC

Under Section 301 of the bill, issuers of ancillary assets would be required to make certain disclosures to the SEC.


By complying, digital asset issues will be "commodities".


So most of crypto will be regulated by the CFTC


But the SEC has jurisdiction on securities.

Projects that want to tap into the U.S. market will make disclosure about:

- Their businesses

- Financial condition

- Plan for protecting consumers in the event of bankruptcy.


This will reward those with genuine economic utility and honest intentions.

The bill also allows for innovation.


It enable states to establish “financial regulatory sandboxes” within which crypto projects could work, for a maximum of two years, without risk of being shut down by regulators. Although 2 years may still be too short. It's still a start.


In a recent AMA, @cdixon, @JakeAuch & @milesjennings shared their thoughts on Web 3 and the bill:


Thoughts on Web 3

Web 3 is a movement set to unlock immense innovation.

Communities can operate on these networks that have been created by blockchain enabled tokens.


There are many use cases:

-Some are digital, some are offline.

-Like allowing for creative people like musicians & writers to earn - which is pretty exciting.

-Also, removing the need for large intermediaries like Google & Facebook who take the profits.

-Web 3 will unlock lots of new business models."

Stablecoin Policies

The bill strikes a medium between banks as stablecoin issuers and anyone, in general. Banks and non banks can both issue stables. Non banks have to work through federal regulators and liquidity requirements. Algo-stablecoins are outlawed in the bill. Some stablecoins like USDT have been here for a while. But, it's a relatively new industry and we need more experimentation. It may be better to provide a hierarchy of stability of stablecoins, that's both accessible and digestable by consumers.

Tax Clarity

The bill cleans up tax issues. If you're using crypto as a medium of exchange and you're exposed to negligible appreciation. You don't have to pay taxes on this. It's marks the start of greater tax clarity in the crypto industry.

State Expectations

It provides more clarity and disclosure for states and consumers: For state governments - about how they're allowed to regulate crypto. And for consumers - about what they should expect when they're engaging with crypto issuers or stablecoin issuers.

DAO's

It makes an initial step towards establishing some legal frameworks for DAO's in the context of the federal tax law. Initial steps are the foundation we need in this market. DAO's are still trending. Better legislation means we could see more people flock to the U.S.

Afterthoughts

What is missing from the bill?

We need greater disclosure on insurance and rated markets. And we need NFT legislation. They will both pose a regulatory problem in the near future: Some NFT's could be regarded as securities - according to The Howey Test. Because an NFT can do a lot more than a physical piece of art. You can imbue it with external value. We need a framework that aligns the incentive to protect consumers from scams but still deliver value. Perhaps some good ways to do this would be to integrate better with policy makers. NFT influencers working to provide a high level education to Congress. An idea for short term regulation could be SRO's: SRO's (Self regulatory organization) Bring some frameworks to legislate. Let the community take initiatives on the financial services side of SRO’s. Create your own apparatus to police bad actors. SRO's can be beneficial and act as a good buffer for industry regulators."

The regulator also said, in its view, that certain crypto interest account providers were providing unregistered securities, such as BlockFi and Voyager."

“The Department warns California consumers and investors that many crypto-interest account providers may not have adequately disclosed risks customers face when they deposit crypto assets onto these platforms. Consumers are encouraged to exercise extreme caution before responding to any solicitation offering investment or financial services.”
